TERMS AND CONDITIONS of providing services by electronic means www.1925.eu

  1. General provisions
    1. These Terms and Conditions of providing services by electronic means (the “Terms and Conditions”) define the rules of using the Atelier 1925 website run under address www.1925.eu (the “Website”).
    2. Person visiting the Website’s pages and subpages, as well as using it, acknowledges and agrees to conditions defined in these Terms and Conditions.
    3. The Website’s operators are Szymon Tarnowski and Agnieszka Kuratczyk, who jointly run a business activity in the form of a partnership known as Atelier 1925 with registered office at ul. Polna 18/20, 00-625 Warszawa, Poland, possessing NIP no.: 7010515614 and REGON no.: 362787070 on the basis of an entry made in the Central Electronic Register and Information on Economic Activity (jointly referred to as the “Operator”).
    4. The Website users are persons using the Website (hereinafter referred to jointly as “Users” or individually as “User”).
    5. The Operator provides services by electronic means according to Terms and Conditions, Act of 18th July 2002 on provision of services by electronic means and other provisions of the Law in force on the territory of the Republic of Poland.
    6. Unless stated otherwise, the intellectual property rights to materials present on the Website are attributable solely to the Operator. Unless separate contracts or mandatory provisions of the Law state otherwise, any copying, printing, and public playing of content published on the Website is forbidden.
    7. No information published on the Website constitutes as offer in the meaning of Civil Code.
  2. Type and scope of services provided within the Website
    1. The Operator provides via the Website free of charge services that consist of allowing the User to browse all functionalities of the Website (the “Services”), including:
      • browse contents available on the Website’s pages;
      • saving products available on the Website’s pages in the “Saved” section along with their selected quantity;
      • submit queries regarding saved products through the “Ask about product” form available on the Website’s pages.
    2. The Operator is responsible for the quality of Services. The User should submit any and all complaints related to irregularities in the Website’s operation, including complaints related to incorrect quality of Services, to the Service Provider under e-mail address: info@1925.eu and provide his/her full name, e-mail address, and complaint submission reason. The complaints will be reviewed within 14 days from the submission date.
  3. Technical conditions for using the Website
    1. Using the Website via the Internet is possible provided that the device, which the User uses, meets the following minimum technical requirements:
      • Internet browser: Internet Explorer, Mozilla Firefox, or Google Chrome in current version available on the market or in previous version that can operate JavaScript and Cookies;
      • Control: keyboard, mouse, or touchscreen.
    2. The Operator is not responsible for e-mail server administrators blocking the ability to send e-mails to address indicated by the User, as well as for deleting and blocking e-mail messages by software installed on a computer or other device used by the User.
    3. The Operator indicates that the failure to fulfil technical requirements mentioned in par. 1 above by the User can prevent or hinder the User from using the Website.
    4. The Operator informs that using the Website requires an Internet connection, which may be related to the following specific hazards:
      • possibility of “infecting” the computer or IT system by malware created i.e. for the purpose of causing damage or illegally gaining access to data (software commonly known as viruses or trojans);
      • possibility of endangering to actions of persons intending to illegally gain access or cause harm to the Operator or User’s IT system.
    5. In order to safely use the Internet network, it is suggested to install a legal antivirus software that protects the User’s computer against hazards indicated in par. 4 above.
    6. While using the Website, the User is obliged to follow the Law and social co-existence principles.
    7. The User is forbidden from using the Website in a way contrary to the Law, good practices, or violating justified interests of the Service Provider. In particular, the User will not undertake activities that could expose the Operator to any financial harm.
    8. The User is obliged to refrain from any activities that could influence the correct functioning of the Website, including in particular interfering with the Website’s contents or technical elements, including provision of contents that may disrupt or damage computer systems.
    9. The User cannot provide contents of illegal nature, i.e. in particular such contents that violate the rights of other persons, contents of discriminatory and offensive nature, contents encouraging to commit a crime, and violating absolutely applicable provisions of the Law.
  4. Exclusions of Liability
    1. The Operator reserves the right to conduct maintenance works that may hinder or temporarily prevent the ability to use the Website.
    2. The Operator is not responsible for the User not being able to access to the Website that results e.g. from technical limitations of the User’s equipment.
    3. The Operator is not responsible for e-mail server administrators blocking the ability to send e-mails to address indicated by the User, as well as for deleting and blocking e-mail messages by software installed on a computer or other device used by the User.
  5. Cookies policy
    1. The Operator uses Cookies.
    2. Cookies are IT data, in particular text files, which are stored in the User’s end device. Among other things, Cookies contain name of website they originate from, time of storing them on the end device, and unique number.
    3. By using the Website, the User agrees to use Cookies according to current browser settings.
    4. Cookies are used to:
      • adjust the content of the Website’s pages to User’s preferences and optimising their use; in particular, these files allow to recognise the User’s device and properly show the Website adjusted to his/her individual needs;
      • create statistics that help to understand how users use web pages contained in them, which in turn allows to improve the Shop’s quality of operation.
  6. Privacy policy
    1. The Operator is the administrator of personal data processed in relation to the Website’s operation.
    2. The Operator process personal data of Users indicated in the “Ask about product” forms, including information considered as personal data, while respecting provisions of the Law applicable in this scope, in particular according to the Act of 29th August 1997 on personal data protection (Polish Office Journal of 2002 No. 101, pos. 926 as amended) and Act of 18th July 2002 on provision of services by electronic means (Polish Office Journal of 2002 No. 144, pos. 1204 as amended) in order to allow the User to use the Website while utilising safety measures required by the Law.
    3. The Operator reserves the right to disclose selected information regarding the User to authorities or third parties that will submit a request to disclose such information on the basis of appropriate legal grounds. Aside from cases indicated in previous sentence, information concerning the User will not be disclosed to any third party without said User’s consent.
    4. The User’s data are stored for no longer than it is necessary to use the Website and then they are removed from the system.
    5. Each User has the right to access his/her personal data, correct or complete them, and right to request cease of data processing and removing them by addressing the Operator in writing regarding such rights. In the event of removing data conditioning the use of separated Website resources and services offered within the Website, the User loses the ability to use such data.
  7. Final provisions
    1. These Terms and Conditions come become valid on the date of publishing them on the Website.
    2. The User can resign from using the Website at any given time.
    3. The Operator reserves the right to change Terms and Conditions. Such changes become valid on the date of publishing them on the Website, but they do not violate rights acquired by Users.
    4. Matters not covered in these Terms and Conditions are governed by provisions of the Polish Law, in particular:
      1. Act of 23rd April 1964 – the Civil Code;
      2. Act of 18th July 2002 on provision of services by electronic means;
      3. Act of 29th August 1997 on personal data protection.
